Facts

The Appellant herein was arraigned before the Kogi State High Court alongside his co-accused and charged for the offence of criminal conspiracy and culpable homicide.

Upon arrest of the Appellant by the police, he made a confessional statement admitting to the offence. However, upon arraignment, the appellant pleaded not guilty to both counts.

At the end of trial, the trial judge found the Appellant and his co-accused guilty on both counts and sentenced them to death.

Aggrieved, an appeal was filed to the Court of Appealed which was dismissed.

Dissatisfied a further appeal was filed to the Supreme Court by the Appellant.
